It may also include information needed to identify beneficial owners, trustees, directors, representatives or other people connected with a purchase; information obtained through identity verification, customer due diligence and AML/CTF risk assessment processes; information about properties you own, are considering purchasing or have asked us to investigate; details of property inspections, negotiations, offers, contracts and transactions; and information contained in communications, documents, forms and enquiries you send to us.

We may further collect payment, invoice or transaction information where relevant; information about your dealings with selling agents, mortgage brokers, financial planners, accountants, conveyancers and other professional advisers; feedback, reviews, survey responses or testimonials you choose to provide; website and technical information such as your IP address, browser, device, approximate location, referring website, pages viewed, links selected and time spent on our website; and any other information reasonably necessary to provide our services, operate our business or comply with the law.

We may also collect personal information from selling agents, property owners, property managers and other property professionals; from mortgage brokers, lenders, financial planners, accountants, conveyancers, solicitors, building inspectors and other service providers; from government registers, property records, publicly available sources and social media; from property information providers, including Cotality RP Data; through identity-verification and AML/CTF service providers; and automatically through cookies, analytics, advertising pixels and similar website technologies.

If you provide personal information about another person, you should ensure you are authorised to provide it and that the person is aware of this Privacy Policy where appropriate.

AML/CTF information

We may be required to collect and verify personal information to comply with Australian AML/CTF laws.

This may include information about your identity, address, beneficial ownership, source of funds, transaction, representatives and other matters relevant to customer due diligence and risk assessment.

We may check this information against identification documents, databases, public records, sanctions lists, politically exposed person information and information held by verification providers.

If you do not provide information reasonably required for these purposes, we may be unable to commence or continue acting for you, complete a transaction or provide certain services.

We may disclose relevant information to AUSTRAC, law-enforcement agencies or other authorities where required or authorised by law. We may be legally prevented from telling you about certain checks, reports, disclosures or investigations.

Who we may share information with

We may disclose personal information where reasonably necessary to our employees, representatives and contractors; selling agents, property owners and property managers; conveyancers, solicitors and settlement providers; mortgage brokers, lenders and finance professionals; financial planners and accountants; building, pest and other property inspectors; valuers, surveyors, engineers, town planners, tradespeople and other property specialists; and insurance providers and brokers.

Disclosure may also be made to professional advisers, auditors and consultants; referral partners where you have authorised the referral or it is reasonably expected; customer relationship management, identity-verification and document-management providers; website, hosting, email, cloud-storage, communications and cybersecurity providers; analytics, advertising and marketing providers; property information and research providers, including Cotality RP Data; and Squarespace, Google Workspace and other technology providers used to operate our business.

We may further disclose personal information to AUSTRAC, government agencies, courts, tribunals, regulators and law-enforcement bodies; parties involved in an actual or proposed business sale, merger, restructure or transfer, subject to appropriate confidentiality arrangements; and any other person you authorise us to disclose information to.

We may also disclose information where required or authorised by law, where reasonably necessary to investigate suspected unlawful activity, or where necessary to prevent a serious threat to health or safety.

We do not sell personal information as a standalone commercial product.

Storage, security and marketing

Overseas storage and disclosure

Some of our technology, website, cloud, analytics, communications and service providers operate or store information outside Australia.

Personal information may therefore be stored, accessed or processed overseas, including in the United States and other countries in which our providers or their subcontractors operate.

For example, Squarespace stores website data in data centres in the United States, and other providers may use distributed international infrastructure.

Where full copies of identification documents are no longer reasonably required, we will take reasonable steps to delete or de-identify them while retaining any records required by law.
